Umsiti Health: Terms and Conditions of Service
Welcome to Umsiti Health. These Terms and Conditions (“Terms”) govern the access to and use of Umsiti Health’s telemedicine and digital health services (“the Services”), including virtual consultations, health assessments, e-prescriptions, referrals, and related offerings made available through our mobile app, website, and associated platforms (“the Platform”).
By accessing, registering, or using our Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not use the Services.
1. Definitions
- “Umsiti Health” / “We” / “Us” refers to Umsiti Digital Health (Pty) Ltd, a private company incorporated under South African law.
- “User” / “You” / “Patient” refers to any individual accessing or using the Services, including guardians of minor children.
- “Healthcare Provider” means an independent licensed medical professional registered with the Health Professions Council of South Africa (HPCSA) or other relevant regulatory authority.
- “Consultation” refers to a virtual, telephonic, or chat-based interaction between a User and a Healthcare Provider via the Platform.
2. Nature of the Services
Umsiti Health provides a digital health platform that facilitates access to healthcare professionals. We do not operate as a hospital, clinic, or emergency service provider. All medical advice is provided independently by licensed practitioners.
- We facilitate but do not interfere with the patient-provider relationship.
- Emergency conditions or life-threatening illnesses must be referred to emergency services (dial 112/10111).
3. User Eligibility and Account
To use the Platform:
- You must be 18 years or older or have parental/legal guardian consent if under 18.
- You agree to provide true, accurate, and complete information during registration.
- You are responsible for maintaining the confidentiality of your login credentials.
4. Fees and Payments
- Pay-As-You-Go consultations are charged per session and must be paid in advance.
- Subscription Plans (e.g., Umsiti Plus, Family Plan) are billed monthly and auto-renew unless cancelled with 7 days’ notice.
- All payments are processed securely via third-party payment gateways.
- Umsiti Health is not a medical aid and does not guarantee reimbursement from health insurers.
5. Refund & Cancellation Policy
- Pay-As-You-Go: No refunds once a consultation has commenced.
- Subscription Plans: Refunds are not issued for unused services within a subscription period. You may cancel before your next billing cycle.
- In cases of technical failure or provider unavailability, Umsiti may offer rescheduling or credit at its discretion.
6. Medical Records and Confidentiality
- Umsiti Health complies with the Protection of Personal Information Act (POPIA) and applicable healthcare confidentiality standards.
- All medical records, consultation notes, and prescriptions are stored securely using end-to-end encryption.
- Your data will not be shared without your consent, except as required by law or court order.
7. Scope of Care
Umsiti’s platform is suitable for:
- Non-emergency medical concerns.
- Chronic condition management.
- Lifestyle and wellness support.
It is not suitable for:
- Medical emergencies.
- Invasive procedures.
- Conditions requiring physical examination or diagnostics not available digitally.
8. Disclaimers and Limitation of Liability
- Umsiti Health is not liable for any loss, injury, or damages arising from reliance on information provided during virtual consultations or referrals.
- While we vet healthcare providers, Umsiti does not assume liability for malpractice, negligence, or misdiagnosis by independent practitioners.
- All services are used at your own risk, and no warranties are given as to the suitability of a practitioner for your specific health needs.
9. Intellectual Property
All content on the Platform — including logos, designs, software, and health tools — is owned or licensed by Umsiti Health and protected by intellectual property laws. You may not copy, modify, distribute, or exploit any content without prior written permission.
10. Modifications to Services
We may modify or discontinue services at any time, with or without notice, including pricing, available practitioners, or features. Your continued use constitutes agreement to any updated terms.
11. Jurisdiction and Governing Law
These Terms shall be governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts of South Africa.
